Legal Question in Workers Comp in California
Working as a temp employee through a agency I tore my knee and was disabled on a job site, the temporary position was refilled but I am still on full disability through my hiring agency, How long do I rate total disability? Will I get a chance to go back to my temp position? I have had surgery and am currently in physical therapy for one more month, what is the specifications on coming off of disability and being unemployed. I was told I will not be able to do the labor intense work as I had done for years before becoming injured. Are there any programs to help me become retrained in a new field to find work? I was with the agency for five months befor the injury , now in my eight month.

As long as your doctor believes that you should be on total temporary disability status (TTD) you will be getting benefits up to two years. At the end of your case, you need to do a AME/QME evaluation for rating purposes. The rating entitles you to a job displacement voucher for vocational training.
