Legal Question in Workers Comp in California
workmans comp
I was filed a w/c claim in 10/08. My company is a private HMO and is also my insurance/claims adjuster/medical examiner, etc.... I was denied the claim but the state sent me to a QME and he said that my injury is my employers fault. I was on stess leave. I am being treated for major, recurrent depression and anxiety by initial MD. I am back at work and the QME said that I am not even at a point that I have begun treatment but I am able to work. The QME also stated that my claim was probably denied on ''personnel actions''. So what is my next course of action? My supervisors have not let up on the stress either. Since returning to work, I have been accused of not calling/submitting owo in Dec 08 and was suspended for a day. Also, I have been in there office almost everyday for a month. I went back to work in March 2009. Being that I work for the company that I am insured with and the claims adjuster and w/c ins. not to mention the MD are all employees of this company also, what should I do? The Md had me in an Intensive outpatient group therapy, which was with general patients, I never really got a chance to talk because I didn't want to badmouth the company. HELP?
