Legal Question in Workers Comp in California

workmans comp or liability

I am a Hvac contractor with no employees, I was hired to do some work on an air cond. unit on a roof of a bus. I fell from 16 feet and broke my heel, does the property owner have any liability or am I elidgable for workmans comp from them? I do not have insurance

I assume you were hired as an independent contractor and they did not set hours of work, give you directions on how to do the work, have the ability to fire you and just owe you for the work done, etc. Those factors would imply that you were not the property owner's employee, so there would not be WC coverage. If you can show the owner was negligent s caused your fall, you could file a civil suit. But did they do anything wrong or was it just an accident in which no one was really at fault?
