Ninety seven year old fractured hip at his volunteer job placed on workmans comp . He has recieved 24 hour aides at home . his doctor writes that it is a medical necessitiy to continue 24 hour care- what is the case law for calif. regarding medical necessity to continue 24 hour home aides for the remainder of his life

If the treating doctor orders in home care, the insurance carrier should provide it. However, in home care is expensive and the carrier will probably be difficult and challenge every demand for in home care. For an injury like this under these circumstances I suggest you try and find an attorney, which may be difficult since the worker was retired and will have reduced benefits.
