While it is illegal to do so, how would you know that they did not run a background check and find any formal filings you made [Application for Adjudication]. If the injuries were handled in the informal process that the vast majority are, I would guess there are no records available to them tom find out. They might ask your former employers; if you reach a settlement with the WC carrier, you might want to include a stipulation that your employer not mention the injuries to anyone, but if they were significant injuries that might be illegal as being against public policy as a new employer is entitled to know of any physical limitations that prevent you from doing the work for the position you are being hired for. Perhaps an employee's Workers' Comp.attorney can response; I did the employers side.
