Legal Question in Workers Comp in California
Work-related injury
I have been off of work for approximately 3 weeks due to a back injury that I received while on the job. My place of employment said that when I get released to go back to work that they will not be giving me back the same position that I had when I went out on leave due to this injury. Is this legal for them to do? I had my injury on Sep. 6th and it is Sep 25. What should I do in this situation?

yes
Re: Work-related injury
This is generally how it works: When one has a work injury, the employer sends the worker to the employer's doctor. After that, the employer's doctor may likely try to release the employee as soon as possible, no matter how much pain the employee may suffer. In your case, you may be released with restrictions. This means that your employer has the right to place you in a modified position.
