Legal Question in Workers Comp in California
Write up after injury
I recently was injured at work. Now that I am back at work I was just written up for this incident. I was written up becuase they are saying it was a preventable accident due to the fact I was not stepping out of my delivery truck ''Properly''. My foot slipped as I was stepping down the steps of my truck it was purely an ACCIDENT, but because I was stepping down the steps backwards instead of forwards they are saying it is my fault. Is this legal?

Re: Write up after injury
It is illegal for employers or their insurance companies to deny worker's compensation coverage based on the fault of the employee. (It is called a No fault system). However, they can give you warning to prevent future injuries. If you were denied benefits under worker's compensation, call us at 213.388.7070 for a free consultation.
