Legal Question in Workers Comp in California

A little over a year ago I slipped, fell, and hurt my tail bone at work. There was no "wet floor" sign. I went to the hospital where they informed me that there was no way they could tell if it was broken/fractured because its hard to detect on that part of the body. Within the past 6 months or so i noticed i can't just lie down without feeling a strong pain in my back. I have to slowly lie down. Mind you I am 18 years old I shouldnt have this problem. Since it has been a year & a couple months since the accident, can I still do something about this?

For Workers' Compensation, a claim must be filed within one year of the date of injury or the last providing of any benefits for the injury. I do not believe that your having been a minor when the accident occurred extends the Statute of Limitations but you should contact some WC applicants attorneys to see whether you can get around the SOL.

If you reported the injury to your employer and you were not provided a claim form or workers compensation information, it might be possible to pursue a claim still.
