Grandchildren

Applied for legal guardianship of our three grandchildren. Received guardianship for the oldest girl from mother and dad. The other two children from a different father. Father is contesting guardianship. Children was allowed to spend Christmas with their mother. Mother has not had kids during their time in Edmonton, they've been with other grandmother. Now grandmother is not going to release the kids back to us. Can she do this? Court order states that we have temporary custody until trial date in late May 2008.

If the court order states that you have "temporary custody until the trial date in late May 2008" you are the person entitled to have custody of the children. For the other grandmother to not release the kids back to you is kidnapping.

I suggest speaking with your lawyer to put pressure on the other grandmother. You may also want to inform the police if she refuses to return the kids pursuant to a court order.
