Legal Question in Technology Law in Canada

Unfair university charges

I recently decided to drop two university courses at Concordia University. I tried to drop them a few hours before the deadline(after the deadline, students are charged the full fees for dropping a course). I was unable to drop the courses because there were too many people trying to access the system (MyConcordiaPortal) at the time. I dropped the courses a couple of days later and was told that I will have to pay all fees despite the fact that many other people were in the same situation. I was told that it was my fault the system did not work because I waited until the last minute and should have known better.

Is the University liable for the systems failure?

Can I file a class-action with all the other people in the same situation as me?

Any advice you have would be greatly appreciated.

Thanks.

Re: Unfair university charges

I think this is a new phenomenon as computer law is not very developped yet. I think it would be a good case 1) for your pocket 2) for the advancement of law. Im interested in this kind of case! Tell me if you want to go forward, we can manage an arrangement for the fees (class actions are entitled for government help)
