responsible for products returned

My 20 year old son signed up for trial acne product from Striaex. Found out they will auto bill for $159.99 for a 3 month supply if trial kept. Returned tiral to Canada day after it arrived. Canceled credit card. no payment has been received and they are threatning to send him to collections if he does not pay. He has no product and they say they never received the trial back. This was 10/24/07. He has no 3 month supply and trial was returned within the 25 days of purchase. Can they send him to collections and ruin his good credit standing?

How did he sign up; online, by mail, on the phone? Did you keep the postal receipt for mailing back the trial sample? Otherwise, you seem to have done a good job so far. They can refer it to a collection agency. If they do, you should retain an attorney to deal with the collection agency and to insure they comply with the Fair Debt Collection Practices Act.
