Re: repair bill despute

The questioner has not really given enough information and to provide a definitive answer; the documents would have to be examined, but in British Columbia the dealer would have little chance of sucessfully collecting if it sued. As the dealer has given up possession of the truck, the dealer is not able to file a repairer's lien and if it does, then the Court would order it discharged with most likely a penalty paid to the vehicle owner and costs as well. The questioner would be well advised not to take the vehicle back to the dealer for any future work however. The questioner should do nothing that could be construed as acknowledging that a debt exists; the questioner should simply advise the dealer in writing that the questioner owes no money and considers the matter closed, and say absolutely nothing else, and not respond to future threats or demands.
