Legal Question in Criminal Law in Canada
wrongfull domestic dispute and arrest
Dear Lawyer. My younger brother had a mild crisis after having consumed with aspirin for back pain; He halucinated and thought that my sister and I were going to harm him, He dialed 911 and I hung up the phone, I tried to get a grip of him and resisted in delf Defenece. Some time later the police arrived , put my brother in hand cuffs and brought him off to jail, He passed court was released on his own recognizance but with conditions: that he does not reside with us for a specified duration - our parents home- build and restore and that he must attend alcoholics anonymous meetings.
He is now being charged with agressive conduct and I don't know what else, the police insisted that my sister and I testify against him. But we have no intention of doing so, My brother has never committed any crime, earned 2 university degrees, we love him ever since he was born, has absolutely never threatened anyone and never harmed a soul.
I am distraught that he finds himself in this position. He must return to court

Re: wrongfull domestic dispute and arrest
Dear Family Member:
You have not provided enough particulars for me to tell you anything specific, but enough to know that you should arrange for your brother to be represented by a lawyer experienced in these kind of cases. If you are in a larger centre, you should have much difficulty finding someone. Perhaps he qualifies for legal aid. If you live in a smaller town, you might consider searching for a lawyer in bigger place who is willing to travel to your brother's court.
