Legal Question in Family Law in Canada

I just asked my ex to have our son stay with me for three days a week she said no. we are supposed to go to a mediation hearing on sept 25. i have not contacted them to say i will attend the hearing. i do not believe that i have to wait another 30 days to spend time with our son,yes or no? HELP what do i do ? go to court for custody? or an access order? i dont know what to do.

You can apply for an access order on 8 days notice. If the mediation is under the Rules of Court attendance is not voluntary; you must attend. If mediation is not forced, then you should have had a say in choosing the mediator.
