Legal Question in Family Law in Canada

Can an aunt apply for custody and access of her niece on ground of verbal and physical abuse. As well as an unsafe environment if a case is already in progress between mother and father of the child?

In British Columbia, any person may apply for custody under Section 35 of the Family Relations Act.
