Legal Question in Family Law in Canada
Biological Father's Rights?
this is simple, but a bit of a long story.
while i was pregnant, my boyfriend (babys father) assaulted and threatened to kill me. he was charged and went to jail for 44 days, now is on probation for 2 years and isnt allowed within 500 meters of me. he also isnt allowed to contact me. he hasnt made any effort to take care of his son, he doesnt even acknoledge that he has a son. he is taking councilling and drug rehab programs. Because he put me in danger and threatened me while i was pregnant, it was dangerous for both myself and the baby. now i am a single mom, living off of assistance with no other help. before i ask for child support i need to be sure the father wont be able to put me or my son in danger again. will he be able to see my son? will that change after he is off of probation? will i be able to get any kind of support from him at all?
thankyou

Re: Biological Father's Rights?
In British Columbia,if you are on social assistance the government exercises your right to child support, and you have little or no say in whether or not the government sues the father for child support.
You have not given anywhere near enough information for us to guess whether or not the father will be able to see the child, but in most cases if the father wants, he can, because the child is equally his.
