canada - vary joint custody

I filed for divorced in 2001 due to abusive husband. I got a restraining order, since he had beaten me and threaten me with my life. After a lengthy process I finally got the divorce in 2007, through the lawyers we agreed to have joint custody with me being the primary caregiver.

later he had become abusive again and start threatening me over the phone. I had one of such calls taped and presented to Police, he got arrested.

Its extremely difficult to carry on with this joint custody as it is. I would like to appeal for sole custody and move out of province to my parents. What are my chances? I am living in Manitoba and I do not have any immobility clauses in the divorce agreement.

In British Columbia, your chances would be fairly good, but in Manaitoba we can not say as our firm is not licenced to practice in that Province.
