Legal Question in Family Law in Canada

Change in support amounts

My partner and I have purchased a house together and will be moving in shortly. He is in the process of getting a divorce but unfortunately, he does not yet have a completed separation agreement with his ex-wife. Will her spousal and/or child support entitlements now automatically be based on our combined income rather than on his alone?

(My partner and I both work full-time and each make significantly more than she does)

Re: Change in support amounts

No. In B.C. spousal and child support payments are based on the former partner's income only, except when hardship is claimed. "Hardship" is a specific concept with a specific arithmetical calculation prescribed byt he child support guidelines. You should see a lawyer for a detailed explanation. There are many family lawyers in your community.
