Child custody

A woman had her two children taken from her by FACS and one was placed with an aunt, the other with a grandmother. The father wants custody of his children, but FACS says since the seizure of the children was voluntary, it is up to the mother who gets to care for her children. The mother is being spiteful and will not allow the father to have them; however, FACS will not allow the mother to take them back for at least six months or when she can prove she can care for them. There is no court order against the father having access to his children, so what are his legal rights? Can he just take them or does he have to get a lawyer and fight for custody through the courts?
