i read your answer about B.C law however my husband and i live in ON, my step daughter is 11 and wants to live with us her mother is very strongly against this as she will lose her child support there is drugs done in the home as well as an older sibling beating on her what route should i be taking to her into a safer home like with us ?

You should consult an Ontario lawyer as the law does differ from Province to province, but in B.C. I would make application for a change in custody and for an Order to have the child examined by an independent Psychologist or Registered Clinical Counsellor, to determine what her true wishes are and what is in her best interest separate and apart from the wishes and beliefs ofboth competing homes. There would have to be a material change in circumstances that has occurred from the time th original custody Order was made.
