Legal Question in Family Law in Canada

When does child support end

My son was living with me then he graduated high school and moved in with his father got a full time job and had no plans of going to school. A month and a half after he moved in with his dad he turned 18. In my view my child support obligation has ended because he is 18 and working full time. Then in February he decides to go back to high school and brush up on his marks. Now that he is back in school does child support start up again or is it stopped because he had already finished school and was working full time.

I do have a divorce agreement that states that support has to be paid until 23 and in school but it doesn't specify if the child stops school then decides to go back.

My ex doesn't need the money, he makes over $100,000 a year and his wife makes about the same and I make $18,000 a year. He just wants to try and hurt me any way he can think of. I give my kids money whenever they ask if I can afford. I probably give them more money than he does since he makes my son pay for all his school expenses, transit tickets and entertainment. My son still comes to me to buy him clothes because his father wouldn't.

I just need to know if I will have to start paying him support now that my son has gone back to school

Re: When does child support end

In British Columbia you must pay child support until the child is 19 whether or not he is working. When the child turns 19 his status can be re-evaluatd. If he is in school then it is likley that his status as a child entitled to support will continue.
