Legal Question in Family Law in Canada

child support

If my ex girlfriend and her boyfriend have been living together for 9 yrs should my child support payments be reduced? I don't know if they have been claiming single or common law.

Re: child support

It is irrelevant if they are caliming single status or married status for their taxes. The obligation is to support the child. The child has 3 "parents" as that terms is defined in British Columbia. Soemtimes a court will order the former partner to pay full child support and sometimes the court will apportion the responsibility between the former partner (the father) and the new partner (the step-father). Further examination of the issue is beyond the scope of LawGuru and the questioner should seek the advice of a lawyer practicing in British Columbia.
