Child Support

I am the mother of a 5 year old daughter (reside in Alberta, Canada). Her father and I were never married, and he has never even seen her, (his choice). He has never paid any form of child support. Is there any way I could try to get a court order for child maintenance, or is there a statute of limitations on seeking financial assistance with rising my daughter?

As noted on the LawGuru website, this firm is required to answer with reference to British Columbia law, but we doubt very much that the law in Alberta is any different than in B.C. Whether or not the father has had contact with his daughter is completely irrelevant to the issue of child support; he is the father and the Courts will require him to pay the amount set under the Child Support Guidelines. You may have difficulty obtaining an Order for back support; it is not impossible but you have not given enough facts for us to give even a preliminary opinion on whether or not you would be able to collect back support, but as for child suipport into the future, we see no obstacle. You are very strongly advised to seek the advice of a lawyer and if you can not afford one, you may be entitled to Legal Aid.
