Legal Question in Family Law in Canada

Childeren's Aid Society

If CAS (Children's Aid Society) show up at your door, are you allowed to refuse them entry? What is the process for them to gain entry if you do refuse. Are they allowed to take pictures of your home because it's messy? Is there something I can do to get them to stop harassing me?

Re: Childeren's Aid Society

As noted on the LawGuru website, all questions directed to this lawfirm must be answered with reference to british Columbia law.

In British Columbia thee is no such entity as the Childrens' Aid society (CAS); all child protection matters are dealth with by the Ministry of children and Family development.

Under Section 17 of the British Columbia Child, Family & Community Services Act, Ministry workers have the power to obtain Orders for the apprehension of children (and other orders)that they believe may be in need of protection if they are refused assess to the child, and they can get such Orders by telephone (while they are at the doorstep being refused entry) if necessary. In B.C. the social workers may certainly take pictures of anything they believe may for evidence.

If social workers are, in your opinion, harassing you, the best way to become uninvolved with them is to take parenting courses, obtain an education so that you can get a good job, refrain from using any illegal substances (even marijuana), drink only in moderation, cultivate friends who are good workers, who don't abuse substances, are who are not verbally or physically abusive to anyone.
