Legal Question in Family Law in Canada

childrens lawyer

My son, soon turning 12, is in the custody of his father in another province. He has asked repeatedly to live with myself, his mother, and his siblings. His father refuses and we are told he must be 12 to do this without his father's cooperation. Can he hire a lawyer or should I hire one for him as I am 3 provinces away I am uncertain how to go about this in the best way.

As noted in LawGuru, all questions dircted to this lawfirm will be answered as the law stands in British Columbia, which is the jurisdiction in which we practice and are licenced. In British Columbia, you are required to be the litigant; your son has no authority of ability (called "standing") to make any application to the court. You do not hire a lawyer for your son; you hire one for yourself and apply tot he Court to vary the present custody order.
