Legal Question in Family Law in Canada

Conflict of interest???

I am currently going through a divorce and we had agreed to do it without lawyers. The matter was to be set down May 4th 2009 on which date there now shows a correspondence from a lawyer in the registry. This lawyer has represented me in the past in another matter and I was the one who introduced them when she was going through her first divorce (I should have known better) Is this a conflict of interest? If so what does one do in order to have him removed from the case?

Probably, but it depends to a certain extent on whether or not the lawyer learned information about you that could impact on the divorce proceedings. As a matter of good practice in British Columbia, most lawyers who had representd you in the past for any matter would decide not to represent the opposing party against you, even if it technically acceptable to do so.
