Legal Question in Family Law in Canada
Court Order/Settlement - How long does he have?
My ex-husband has signed an agreement, which has been entered in court, requiring him to provide a certain settlement as a result of our divorce (partial cash, partial pension plan payout). He also has to take my name off of a loan we had taken out to purchase his truck. The problem is, it has been over three months now and nothing has been done to provide the settlement or to refinance the truck loan in his name only. As well, he has known for well over a year that this would be his responsibility. How long does he have legally to provide the settlement and refinance the truck loan? The longer he delays, the more money I am losing to interest charges, etc. on debt I can't consolidate until he takes my name off that loan.

Re: Court Order/Settlement - How long does he have?
There is no time limit; but the longer you let it go, the more you are at risk. I do not know why your lawyer did not ask for a specific time period to be stated in the order, but as he/she did not, you should act quickly to enforce the order. It is a complex process, far too much so to describe in a summary way here. We can arrange a no-cost more in depth initial consultation if you wish.
