Legal Question in Family Law in Canada

custody change?

If my ex-husband's new wife is an alcoholic, spanks my children and verbally and emotionally abuses my children, do I have a legal right to have the custody changed? Right now they go to dad's every second weekend, but they are terrified to go. The problem is not dad, except for the fact that he puts them in this situation by remaining married to her. Is there anything I can do to make him see the children without seeing the new wife?

Re: custody change?

You can change the custody or access conditions if there is a serious concern for the best interest of the children. The procedure is called "Motion" to change the order.

You may want to check with the lawyer who did work the original custody and access procedure.
