Legal Question in Family Law in Canada

death of my mother and her will

my mother left her estate to my brother who has since been deceased and to a charity of her choice. my question is the lawyer that has been handling the case told me it would take 6 months before finilazing everything. now I am going into the eighth month and still waiting for a response to finish this up. his secretary was to have written the letter to the charity before issuing any money to me. why would they make me wait for the response from the charity even though i am entilted my brother's share. and what can i do about this situation

Re: death of my mother and her will

You have an interesting issue, but unfortunately our firm can not answer it as we don't know what Province you are located in. The rules surrounding handling estates vary greatly from Province to Province, so it is important to know where you are. In B.C. 8 months is not unusual, since the law often (but now always) requires a wait of at least 6 months; however a great deal more of your family situation would have to be known before any advice could be given; in addition, our firm cn only give advice with respect to B.C. since that is the Province where we are licenced to practice.
