I have been seperated for several years, I left the family home with my two youngest childen. the youngest who is a special needs child.

Am I still eligeable for a divorce settlement?

You are in all probability entitled to child support, including more than the guideline amount (assuming your special needs child has extraordinary expenses) and may be entitled to spousal support, but this will depend on a number of factors not mentioned in your question. You are most likely entitled to a division of assets (house, investments, RRSPs, CPP and employment pensions, to name just some things that can be divided.) It does not matter in whose name the assets are registered or owned. Your town does not have many lawyers, and none that are noted to practice primarily in the subject area of Family Law (lawyers in B.C. are not allowed to say they "specialize" - only that they practice primarily in a subject area ). You should consult a lawyer as soon as possible; it really does not matter what area of the Province your lawyer comes from, and many would be glad to discuss your matter without a fee for an initial consultation. Yours is a fairly common situation and our firm has handled many similar cases in the last 26 years.
