Can I get an emregency court order that will allow me to stay in the family home and have custody of the children well we work things out in court. I am afraid that my spouse will try to force me out and keep my daughter as his family is very well off and have threatened me with this before/

This answer pertaians to British Columbia only as noted on the Lawguru website. In B.C. you may request the court for an Order for Exclusive occupancy under the Family Relations Act. You may also request a no-contact order or a restraining order. You are not entitled to one as of right, but must prove certain things that are too complex to go into here. You can call the lawyer referral service of the Canadian bar Association - B.C. Branch at 1.800.663.1919 and you will be referred to a lawyer who will give you advice for a nominal fee of $25; many lawyers do not charge this fee and provide the first interview at no cost.
