Legal Question in Family Law in Canada

Fertilized Eggs

If a husband and wife put away a fertilized egg for safe keeping, and later on get a divorce, does the egg count as an ordinary possession? ie. car.

If the ex-wife wants the egg to have the baby, and the husband doesn't want the baby, does he still have to pay child support?

Re: Fertilized Eggs

In all honesty, I have not researched the law on this issue, although I know this exact situation got alot of press sometime in the past few years. I believe strong arguments can be made both ways.

If you would like a definitive answer, I could conduct some research for you. Please contact me directly if you would like to open a file for that purpose.
