Re: Can i file a divorce in canada?
There is no rule concerning filing for a divorce in "Canada"; jurisdictional issues are are dealt with according to the Divorce Act but are dependant on that Act and the Rules of Court in each Province. In the Divorce Act it is specified that a Court in a Province has jurisdiction to deal with a divorce if either spouse has been ordinarily resident in that Province for at least one year. Either one of you can file for a divorce if one of you has been in a particular Province for at least one year, but you must check the Rules of Court for each Province to determine what other requirements must be met.
