Legal Question in Family Law in Canada

she filed for sole custody in another province

hi......my girlfriend of 4 years left me and left the province with my son. she has filed for sole custody in BC while i'm in alberta but has said she is not going to serve me, she has filed because i have checked with the court in BC but she has yet to serve me. is there anything that i can do to supercede her filing first there and to get her to come back to an alberta family court where my son was born and raised up until about 3 weeks ago?

You should check to see if she has filed in B.C. first; she may only be threatening. It may be possible to have the Court in Alberta order her to reurn you son from B.C., but you have not given enough facts to offer an opinion. You should see a lawyer immediately.
