Legal Question in Family Law in Canada

interim order

an interim order has been placed on my property and bank accounts on a recent petition for separation. my ex's lawyer has accused me of disposing of marital assets...is this interim order easy to be removed and what needs to be done to do this...why is this done to me while her assets are free, i feel she was disposing of marital assets too.

Re: interim order

In British Columbia an order to freeze assets is doen so as to preserve them until the case can be resolved by agreement or by Court order, usually following a trial. No it is not easy to emove such an order - the whole purpose is so that the assets remain as they are. If you believe she was disposing of assts, you can obtain an order freezing hers too - but not out of spite - normally in BC such orders are reciprocal - that is they go against the assets of both parties. You should see a lawyer as soon as possible. The British Columbia Branch of the Canadian Bar Association can arrange a referral with a lawyer for about $25.00 for the first 1/2 hour.
