Legal Question in Family Law in Canada
Joint custoday and the step parent
My ex and I have joint custody with my 7 year old staying with me Monday - Friday. I have been married for a couple of years and have 2 other children. I have to go away for a course for 2 1/2 months. My ex wants my son to stay with him and his new girlfriend during that time. I want my son to stay in my home with my husband and his brother and sister. Does he have the right to make my son go to his house or can he still stay here?

Re: Joint custoday and the step parent
In British Columbia, it depends on the terms of the joint custody order or if you do not have an order, on the terms of the separation agreement. Without further details such as the wording of the order or agreement, further exact advice is not possible. This advice applies to British Columbia only as the laws cn vary from province to province.
