Legal Question in Family Law in Canada
Mother of Child refusses father reasonable access
My boyfriends ex (mother of their child) refuses to allow reasonable access to their child, often will cancel visit's at the last minute, and refuses access to their child on days like father's day. She is verbally abusive to him over the phone calling him an f'n a**hole etc. and has hung up on him several times. When he tries to call to make arrangements she often refuses communication with him by not picking up the phone or returning his calls. this makes it difficult to make any plans together with his daughter.
He doesn't know what his rights are as a father. He is the paternal father (verified by testing) there is currently no order for visitation so she thinks she can have full control over the situation stating that she is allowing him to enter his life.
She refuses to acknowledge him as her father and as such his daughter calls him by his first name and not Dad.
Is there a site that can help him to know what his rights as a father are?

Re: Mother of Child refusses father reasonable access
There is no webiste for this. He must see a lawyer. This question was directed to a British Columbia law firm and as noted on the lawGuru website will be answered with reference to B.C. The father is entitled to access, unless there is some reason that makes him unsuitable to see the child. He can obtain an Order for access that specifies when and where; he can also have as a term of the order that if access is refused on medical grounds, the mother must produce a physician's letter or note. If the situation becomes or already is bad enough the father may be entitled to an Order that grants him custody and the mother can have access. He must see a lawyer. For a referral for a low cost 1st appointment see the Telus phone book for the Canadian Bar Association (BC Branch)under lawyer referrals.
