Legal Question in Family Law in Canada

My mother passed away and her legal husband, who has been estranged for 8 years, has come back to try to get money. She did not have a will and I am wondering if he is legally entitled to anything. He is applying to be Executor, and so am I. Do I have a chance? He was abusive but they never filed for divorce. I paid for the funeral and am listed as the next of kin, but it doesn't do a lot.
