Privacy concern

Hi, I recently visited a family lawyer to get advice about a divorce. It was a simple, initial consultation.

During the session I asked that nothing be sent to my home address nor any contact on my home phone. The lawyer noted this in my file.

A few days ago my wife, in order to determine whether I had visited a lawyer, call the lawyer in question and, by impersonating me (by a slight mispronounciation of my name to femenize it) asked them to resend my bill. Unfortunately the lawyers office confirmed the request, essentially telling my wife that I was indeed a client.

My question is: what should I do?

The website should say that enquiries to this firm are limited to British Columbia.

However, how would your wife know which lawyer to call when she impersonated you unless you told her? In such a case, you are at least partly at fault.

In any case, the law firm is not to blame for being duped; your wife however has impersonated you and that is or may be an offence. You may complain to your local police department, saying that your estranged wife has impersonated you in order to gain confidential information and you may ask them to prosecute; they are unlikely to do so for a first relatively minor offence, but may visit her and warn her not to do so again. This may have the effect of preventing future similar behaviour.

You may also have your lawyer ask for an Order restraining your wife from doing so in the future - that way if she does so she may be punished for contempt of court.
