Legal Question in Family Law in Canada

Transfering a Divorce Order to Alberta

My ex wife and I were divorced in British Columbia. I have since moved to Alberta with our two children. I want to change the access agreement in the divorce order, but have been told that i have to return to BC to do so. Is there any way of transfering my BC divorce to Alberta, so that any other issues can be dealt with here? And if there is, how do i go about doing that?

Re: Transfering a Divorce Order to Alberta

No, you can't "transfer" but you may be able to apply to vary the B.C. Order. You likely would obtain a certified true copy of the B.C. Order, file it in Alberta and then apply to vary it. If the situation were reversed, you would do that with an Alberta order in B.C. Interjurisdictional issues are often comples, and you should seek legal advice from a lawyer in Red Deer; there are several competent family law lawyers in that city.
