Legal Question in Family Law in Canada

visiting

At what age my daughter can legally stop visiting (or change date and/or time)her father. We do not specified that in our divorce document. We made that document when she was at primer school and at that time we lived at same area with my ex. Now my daughter is in high school and we moved. It means that she can not see him 3 times a week after her school. We live in Canada, Quebec, Montreal.

In British Columbia, an Order can be made for access until a child is 19; the courts are reluctant to force a child over approximately 16 or so to visit, but a great deal depends on the amount of influence over the decision that the custodial parent has. Each case is unique and will be looked at individually. The custodial parent has a duty to encourage a child to visit the non-custodial parent.
