was involved in auto accident.

both parties agreed not to go through insurance..person I hit provided estimates...has agreed to payments ( over 1 month ) to cover costs. My question is, can the other party still decide to go through my insurance company, although he has alerady accepted 2 payments?

Hello Sir:

I can only speak from the perspective of British Columbia, where I practice.

In BC, the safest approach in these circumstances would be to put the claim through the insurance company, ICBC.

Once the claim is adjusted and prior to the claim affecting your insurance premium rate scale, etc., ICBC will allow you to pay the claim. If you pay ICBC then this accident will have no impact on your insurance rates. ICBC will actually run the calculations to show you how the claim would affect your insurance premiums if it went through ICBC.

This is the course I would recommend.
