Legal Question in Employment Law in Canada

Looking for resolution

In march of 2001, I became ill at work, I recieved a medical clearance to work away from fumes. The manaagement of the factory stated they were going to shut down line. I was put on a ''indefinite medical layoff' My union has failed to address issues. I have full medical clearance, yet my employer has stated that they is no place for me at the plant seeing as I have become ''sensitized'' to the chemicals at the factory. This company is blocking any attempt to return to work. They have claimed undue hardship and my union has not represented me for the past year.What should I do, do you know any lawyers who will help?

Your best chance of recourse lies with the Union. A labour/employment lawyer cannot do a lot for you at this stage as your rights/obligations are subject to your collective agreement. You should attempt to impress your situation upon the union. If they still won't listen, you should consider contacting a lawyer regarding an application to the labour board to have them force the union to assist you.
