Legal Question in Employment Law in Canada
Signed Job Offer letter but NO Job
Hello,
I was offered a job in a company in Canada around 05/15/04 for which I have the signed offer letter. The company hired a lawyer to work on my work permit to Canada. On 09/07/04 they told be that the Canadian Embassy could not give me the work permit because the Embassy wants a Labour Certificate (which takes around 3-4 months, the Canadian company does not want to do that and hence implying that I cannot join them.
I had refused another offer because of the above offer and now after waiting for 4 months I am told I don't have a job!
I would be very grateful if you would tell me whether I have a case here?
Yours Sincerely,

Re: Signed Job Offer letter but NO Job
I do not believe that you have a case/claim. While the offer was made, it was clearly contingent on obtaining the proper documents. The inability to obtain them does not rest soelely with the employer. Thus, you cannot accept the job in reality because it would not be legla iwthout the documents. It is unfortunate, but not something that I believe give rise to a claim.
