Accident Causing Injury

A group of bikers riding 4 wheelers were out one day driving. An accident occured between 2 drivers causing harm to both parties. Both parties were intoxicated at the time and were charged with drinking and driving in court. One party decides to sue the others insurance company, because o fthe accident. Is this possible without proving who is at fault for the accident in court? and what would happen if the party was not covered with the proper insurance? If both parties were proven to be intoxicated how can one person sue the other?

In British Columbia there is no direct action statute allowing a lawsuit against the insurance company for harm caused by one of the company's insureds in circumstances such as described.There is insufficient information to answer the balance of the questions.
