Legal Question in Personal Injury in Canada
Airbags did not deploy
I was involved in a high speed colision (more than 50 mph) where my brand new 2008 Lancer hit a snowbank on the passenger side then flipped over and stopped on the roof (luckily there was no other vehicle involved). Once the tow truck has pulled the vehicle back onto its wheels, there is visible damage to the front and back bumper.
I was wearing my seatbelt but it came off (possibly defective as it requires several tries before it clicks) and I ended up crashing against the windshield. The car is equipped with dual-stage front airbags, side-impact head-protection curtain airbags, front seat mounted side-impact airbags, and driver's knee-airbag. Yet none of these airbags deployed. Please let me know whether I have a case against the manufacturer.

Re: Airbags did not deploy
In British Columbia there may be a case; the law varies from Province to province and as the questioner did not say which Province he/she lives in or in which Province the crash occurrred, and as many more details are needed, we can not provide a more definitive opinion at this time. If the questioner lives in B.C. or the crash occurred in B.C. we would be pleased to provide a further consultation either by phone or in person. We can be contacted through the email address given (the lawGuru website will not allow phone numbers).

Re: Airbags did not deploy
I believe you have a case, especially if the failure of the airbags to deploy caused or contributed to your injuries. Your case would likely require a specialist to describe the airbag problem. If your accident happened in Ontario, please feel free to email me to discuss this in further detail at [email protected]. Good luck!
