Auto Accident Injury

I was involved in a car accident in Oct 2002. I went to physio for 19 months, Over the last few years I have had many difficulties including muscle spasms through entire upper region of my back and neck. I have recently stared physio yet again. I was originally told that I had no right to sue, I was told I had no rights because they were not classifying my injuries as permanent. The other driver had no insurance, yet the vehicle was insured, so there was no opportunity to go through uninsured motorist. The other driver is also related to a police officer, so no charges were laid and I was told to drop it or I would get sued for harassement. I know the atatue of limitations have run out, but due to the fact that I am still suffering, Is there anything I can do?

Unfortunately, your Limitation period expired in October 2004, so you are out of time for a law suit. If injuries aren't permanent and serious there is no claim for general damages.

If you haven't settled your Accident Benefits claim, there may be funds available there for your medical and rehabilitation needs.

If a lawyer gave you bad advice about not being eligible to sue within the 2 year period after your accident, you may have a case against your solicitor for negligence. I do not know enough facts in your case so I cannot comment further.
