Legal Question in Personal Injury in Canada

Compensation amounts

The pharmacist filled out a refill for methadone incorrectly and gave the customer 8.4 times(according to their sample testing) the dose the doctor ordered. This resulted in a coma and hospitalization plus long-term disabilities involving physical, mental and emotional problems. When talking about compensation(they have stated they made the error),what kind of figure should we be looking at?

Re: Compensation amounts

Tough question to answer without having all the details.

If liability is proved 100%, damages would be scrutinized heavily based on pre-overdose health.

If the person was taking Methadone for Heroine addiction, his/her pre-overdose mental health conditions would be a significant factor. If emotional distress is the only injury, damages typically range from $5,000-$10,000 for traumatic neuroses cases.

The 'long-term disabilities' would have to be analyzed carefully. If the injuries from the overdose are exhorbitant, the general damages award would be much higher.
