Legal Question in Personal Injury in Canada

Email Harrassment

I recently had a house problem and left a polite message on the answering machine of a person who was authorized to assist in the problem. Because this incident happened after hours, I left my message on the person's home phone, not on his business line.

He then wrote an embarrasing email to many people we both know commonly, chastizing me for using his personal unlisted number for a business problem, claiming I disturbed him at home because I have no common sense. To stick up for myself, I emailed the same set of people back admitting I should not have used his personal line, but I also made fun of him for being so full of himself to make such a big deal out of this. My tone was very sarcastic, ''like we all know you are sooo important...sorry I disturbed your highness''.

Because of his pompous nature, he is threatening to sue me for libel and harrasment. Can he do this, when he sent out an embarrasing letter to mutual acquaintances about me first? I know this sounds like a dumb problem (and it is)... but when arrogant people are made fun of, they go crazy. Does he have a case at all?

This answer applies to British Columbia and may not apply to other Provinces as the law varies from Province to Province. You have not given enough detail for a proper answer, but from what you have given, it seems like the other person may be liable to you for libel (a form of defamation)but you should not have replied as you did. He may have a case but we doubt it. You should consult a lawyer immediately. Do not continue an exchange with this person. Do not apologize and do not insult him.
