Legal Question in Personal Injury in Canada
liability for personal injury
I was leaning over a reduced rack that was placed next to the service doors when an employee who was pushing a flatbed full of water kegs struck me with the door and I sustained life long injuries. I had checked in the window before turning to look over the rack but she must have been just about to turn the corner into the short corridor preceding the doors as I was only standing briefly before I was hit. I often frequent such racks, which are most often strategically placed in a corner that is out of 'prime' shopping areas and was previously struck by a service door at a different store but was not seriously injured and took no legal steps. The store's insurance lawyer is taking the position that I put myself 'there', and that I should have known better; but I had to stand 'there' in order to shop. They want me to share the blame for the accident. The employee couldn't see through the window because she was at the wrong end of her heavy load, and in fact didn't even notice that I'd been knocked to the floor until she was past the corridor on the other side of the doors and turning her cart into the grocery area.

Re: liability for personal injury
In British Columbia you quite likely have a case; in matters such as these the facts are very important and the depth into which a lawyer must enquire is more than the cursory look that LawGuru is meant for. Please make an appointment with a lawyer in B.C. to discuss your matter. Many lawyers provide an initial consultation no charge. Ask when making the appointment.
